Important: this is a license, not a sale
This End User License Agreement (“EULA”) governs your use of LosslessRec (“Software”). The licensor is Ke.BingKui, an individual software developer operating under the LosslessAI and LosslessRec brands, based in Chongqing, China (“Licensor”). The third-party checkout provider identified before payment may be the legal seller or merchant of record for the transaction. By downloading, installing, activating, or using LosslessRec, you agree to this EULA, the Privacy Policy, and the Acceptable Use Policy.
1. Licensed software
The Software includes LosslessRec program files, documentation, updates, additions, and third-party components licensed for inclusion in LosslessRec.
2. Grant of license
Subject to this EULA and payment of the applicable fee, Licensor grants you a limited, revocable, non-exclusive, non-transferable license to install and use LosslessRec for lawful personal, educational, creative, or internal business purposes. The device limit and term depend on the license purchased: Premium 365 and Lifetime cover 1 PC; Group Lifetime covers 2 PCs.
3. License restrictions
You may not sublicense, rent, lease, lend, resell, redistribute, reverse engineer, decompile, disassemble, modify, or create derivative works from the Software except where applicable law expressly permits it. You may not remove proprietary notices, provide the Software as a hosted service, share a license beyond its device limit, or use it unlawfully.
You may use LosslessRec only for content and systems you own, control, or are authorized to access. You may not bypass DRM, encryption, access controls, copy protection, or security features; infringe third-party rights; remove ownership notices without permission; or record private communications without notices and consents required by law.
4. Installation and activation
You may install and activate the Software only on the number of PCs included with your license. Activation measures may verify license validity and enforce device limits. If you replace a computer or encounter an activation problem, contact [email protected].
5. Trial or evaluation copy
A trial may limit features, output, duration, or other use conditions disclosed before download or within the Software. Purchasing and activating a valid license unlocks the features included with that license.
6. License term and renewal
Premium 365 lasts for one year and renews automatically at $19.99 USD per year until canceled. Cancellation stops future renewals and does not shorten the current paid term. Lifetime and Group Lifetime licenses are perpetual unless terminated for material breach. Prices and terms shown at checkout control the transaction.
7. Updates
Licensor may provide updates, bug fixes, or feature changes. An update may replace a prior version and may be required for security, compatibility, or continued support. Unless expressly stated at purchase, a perpetual license does not guarantee every future major paid upgrade.
8. Ownership
The Software and authorized copies are owned by Licensor and its licensors and protected by copyright, trade-secret, and other intellectual-property laws. This EULA grants a license to use the Software and does not transfer ownership.
9. Support
Available support may include installation, activation, and troubleshooting assistance by email. Contact [email protected].
10. Your recordings
Recordings are created and stored under your control. You are solely responsible for their legality, accuracy, security, use, storage, and disclosure. LosslessAI does not monitor your local recordings. Obtain permission where required and protect personal or confidential information.
11. Termination
You may terminate this EULA by uninstalling and ceasing use of the Software. Licensor may terminate it after a material breach that is not remedied within a reasonable period after notice, or immediately where the breach cannot be remedied. On termination, you must stop using and delete all copies.
12. No warranty
To the extent permitted by applicable law, the Software is provided “as is.” Licensor disclaims implied warranties, including merchantability, fitness for a particular purpose, satisfactory quality, and non-infringement, except where they cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by applicable law, Licensor and its affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages or loss of profits, savings, data, or business opportunity. Aggregate liability under this EULA will not exceed the amount you paid for the applicable LosslessRec license.
14. Indemnification
To the extent permitted by law, you will indemnify Licensor against third-party claims arising from your unlawful or unauthorized use of LosslessRec or your recordings.
15. Export and sanctions
You may not export, re-export, or use the Software in violation of applicable export-control or sanctions laws.
16. Governing law and disputes
This EULA is governed by the laws of the People’s Republic of China. Unresolved disputes are subject to the competent courts in Chongqing, China, unless mandatory law in your jurisdiction requires otherwise.
17. Entire agreement
This EULA, together with the referenced policies and purchase disclosures, is the complete agreement concerning your LosslessRec license and supersedes prior communications about that license. If a provision is unenforceable, the remaining provisions continue in effect.
